1. Introduction and Acceptance

Welcome to VRUM (“VRUM,” the “Platform,” “we,” “us,” or “our”), operated by VRUM GLOBAL, with legal address at Calle Cortez Blanco Pasaje L 13, Antiguo Cuscatlan, La Libertad.

These Terms of Service (“Terms”) govern your access to and use of the VRUM website, booking flows, listing tools, communication channels, verification processes, support services, and related digital services.

By accessing, registering for, clicking to accept, or using VRUM, you agree to be bound by these Terms, our Privacy Policy, and any additional policies, notices, Host Terms, Renter Terms, booking rules, cancellation rules, or other supplemental terms presented within the Platform.

If you do not agree to these Terms, you must not use VRUM.

2. Eligibility

You may use VRUM only if:

you are at least eighteen (18) years old;
you have legal capacity to enter into binding agreements;
you are not prohibited from using the Platform under applicable law;
any information you provide to us is accurate, current, and complete; and
where applicable, you satisfy our identity, age, driver, payment, or eligibility verification requirements.

VRUM may refuse access, registration, listing, booking, payout, or continued use of the Platform where eligibility, compliance, trust and safety, fraud prevention, or legal concerns arise.

3. Nature of the Platform

VRUM operates a digital marketplace that allows vehicle owners, hosts, or providers (“Hosts”) and renters, drivers, or booking users (“Renters”) to connect, publish listings, request bookings, communicate, and complete certain transactions through the Platform.

Except where applicable law requires otherwise, VRUM is not:

the owner of listed vehicles;
the lessor, sublessor, fleet operator, dealership, or transport carrier;
a mechanic, inspector, repairer, guarantor, or insurer of any vehicle;
a party to the rental agreement formed between a Host and a Renter.

VRUM provides marketplace, administrative, technological, verification, communication, payment-facilitation, trust and safety, and related support functions. Except where law provides otherwise, the vehicle rental agreement itself is formed between the Host and the Renter.

VRUM may set platform rules, listing requirements, trust and safety controls, payment processes, identity verification requirements, and booking conditions without becoming the owner, lessor, or guarantor of any vehicle.

4. Account Registration and Security

To use certain features, you must create an account.

You agree to:

provide true, accurate, complete, and current information;
keep your login credentials confidential;
be responsible for all activity occurring under your account;
promptly update any changes to your contact, eligibility, vehicle, payout, or other required information;
notify VRUM immediately of any unauthorized access or suspected security issue.

You may not:

create an account for another person without authorization;
transfer or sell your account;
share your credentials in a way that compromises security;
create multiple accounts to evade restrictions, enforcement, or platform policies.

VRUM may require identity verification, phone or email verification, payment verification, driver eligibility review, or other checks at any time.

5. Host and Renter Roles

Users may participate as Hosts, Renters, or both, subject to our approval and eligibility requirements.

Hosts are solely responsible for:

having legal authority to list the vehicle;
ensuring the vehicle is lawfully registered, maintained, roadworthy, and suitable for rental;
providing accurate listing content, pricing, features, and disclosures;
maintaining any insurance, permits, taxes, or compliance obligations required by law or contract;
honoring accepted bookings except where cancellation is permitted;
complying with Host Terms and applicable law.

Renters are solely responsible for:

providing truthful information during registration and booking;
holding valid authorization to drive where required;
using vehicles lawfully and responsibly;
complying with booking terms, return obligations, traffic laws, tolls, fines, and incident reporting requirements;
complying with Renter Terms and applicable law.

6. Identity Verification, Trust and Safety, and Eligibility Reviews

VRUM may require identity verification, driver verification, document checks, selfie/liveness checks, age verification, payment checks, fraud reviews, sanctions or abuse screening, or other trust and safety measures before allowing a user to register, list, book, drive, receive payouts, or continue using the Platform.

VRUM may use third-party service providers, including Didit and Stripe, to perform or support such checks.

You authorize VRUM to:

request and review verification information;
use third-party providers to verify identity, eligibility, payment, and fraud indicators;
suspend, restrict, delay, or deny access where trust, safety, fraud, compliance, legal, or verification concerns exist.

Passing any verification process does not constitute a guarantee by VRUM that any user is honest, safe, insurable, compliant, creditworthy, or risk-free.

7. Listings and Booking Requests

Hosts may create listings for vehicles subject to VRUM’s platform requirements.

By publishing a listing, a Host represents and warrants that:

the Host has the legal right to list the vehicle;
the listing is accurate and not misleading;
the vehicle complies with applicable law and required documentation;
the vehicle is safe and roadworthy to the extent required by law and ordinary responsible operation;
no listing content infringes any third-party right.

Renters may submit booking requests through the Platform. A booking is not final until the booking is confirmed in accordance with VRUM’s booking flow and any required conditions have been satisfied.

VRUM may place conditions on bookings, including verification, payment authorization, fraud review, host response, availability review, or other operational checks.

8. Pricing, Fees, Payments, and Payouts

VRUM may display booking prices, service fees, taxes, estimated charges, payout amounts, or other amounts within the Platform.

By using the Platform, you acknowledge and agree that:

payment processing may be handled by Stripe and related payment providers;
payouts may be delayed, adjusted, withheld, reversed, or canceled in cases involving fraud, chargebacks, refunds, booking disputes, policy violations, sanctions screening, compliance review, reserve requirements, technical issues, or legal obligations;
VRUM may collect platform fees, service fees, payment-processing-related amounts, cancellation charges, or other fees disclosed in the Platform;
all payment flows remain subject to the rules of the relevant payment provider and applicable law.

Unless expressly stated otherwise, VRUM does not itself provide banking services, stored value services, credit, or insurance.

Users are responsible for any taxes, duties, reporting obligations, fines, or governmental charges arising from their own activities, except where VRUM is legally required to collect or remit amounts.

9. Cancellations, Refunds, and Booking Issues

Bookings, cancellations, refunds, credits, no-shows, disputes, and booking modifications are subject to:

these Terms;
any booking-specific cancellation or refund policy shown at checkout or in the listing;
any applicable Host Terms, Renter Terms, or incident rules;
applicable law.

VRUM may, but is not obligated to, intervene in booking disputes, late returns, no-shows, payment disputes, refund requests, or incident claims.

Where VRUM elects to provide credits, issue refunds, reverse charges, or facilitate a resolution, it may do so in its reasonable discretion, subject to platform policies, provider rules, and applicable law.

10. User Content and Platform License

Users may submit or publish content, including listings, photographs, videos, reviews, ratings, messages, support communications, documents, and profile materials (“User Content”).

You retain ownership of your User Content, but you grant VRUM a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, display, distribute, moderate, and use that content for purposes of:

operating and improving the Platform;
facilitating transactions;
fraud prevention, trust and safety, support, moderation, and dispute handling;
legal compliance and enforcement;
marketing or promotional display of your public listing content, unless prohibited by law or removed from active use.

You represent and warrant that you have all rights necessary to upload and license your User Content and that it does not violate any law or third-party right.

VRUM may remove, restrict, or moderate User Content at any time.

11. Prohibited Conduct

You may not use VRUM to:

violate any law or regulation;
impersonate another person or misrepresent identity, authority, ownership, insurance, vehicle condition, or eligibility;
publish false, deceptive, infringing, defamatory, or misleading content;
evade fees, verification, platform rules, or enforcement actions;
use the Platform for harassment, abuse, threats, scams, fraud, money laundering, or unlawful activity;
interfere with the Platform, including scraping, hacking, malware, automation abuse, or security attacks;
book, list, drive, or use a vehicle in a reckless, unauthorized, or illegal manner;
circumvent the Platform to avoid fees or platform rules for transactions initiated through VRUM;
collect or misuse personal data of other users outside permitted platform purposes.

VRUM may investigate suspected violations and cooperate with law enforcement or regulatory authorities where appropriate.

12. Third-Party Services

The Platform may integrate with or rely on third-party services, including:

Stripe for payments and related services;
Didit for identity verification;
mapping, communications, hosting, analytics, support, and infrastructure tools.

VRUM is not responsible for the independent acts, omissions, products, policies, uptime, errors, or security of third-party services except to the extent required by law for processing carried out on our behalf.

Your use of certain third-party services may also be subject to that provider’s own terms and policies.

13. Platform Communications and Electronic Notices

You consent to receive communications from VRUM electronically, including by email, in-platform message, SMS, WhatsApp, push notification, or other contact method you provide or authorize, where permitted by law.

These communications may include:

account and security notices;
booking and transaction updates;
verification requests;
support messages;
legal notices;
policy changes;
payment, refund, and payout notifications.

Electronic records and click-through acceptances may be used to evidence your consent, acceptance, requests, authorizations, and instructions.

14. Suspension, Restriction, and Termination

VRUM may suspend, restrict, deactivate, delist, hold funds, limit features, cancel bookings, or terminate accounts immediately where we reasonably determine that:

a user violated these Terms or another platform policy;
information provided was false, misleading, or incomplete;
there is fraud, abuse, legal, payment, trust and safety, or security risk;
verification or compliance requirements were not satisfied;
continued access could expose VRUM, users, payment providers, or third parties to harm or liability.

You may stop using the Platform at any time. Termination does not affect rights, obligations, fees, liabilities, consents, licenses, dispute provisions, or claims arising before termination.

15. No Warranty Regarding Vehicles, Users, or Continuous Availability

To the maximum extent permitted by law, VRUM provides the Platform “as is” and “as available.”

VRUM does not warrant that:

any listing is accurate, complete, lawful, safe, available, insurable, or fit for a particular purpose;
any Host or Renter is trustworthy, compliant, properly licensed, insured, or risk-free;
any booking will be completed without cancellation, delay, damage, dispute, or loss;
the Platform will be uninterrupted, error-free, or immune from fraud, abuse, or technical issues.

Any verification, moderation, trust and safety, identity review, or payment screening performed by VRUM is a platform risk-reduction measure only and not a guarantee.

Nothing in these Terms excludes any non-waivable rights you may have under applicable consumer protection law.

16. Limitation of Liability

To the fullest extent permitted by law, VRUM and its affiliates, officers, directors, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profit, loss of goodwill, loss of use, loss of revenue, loss of data, vehicle damage, personal injury, fines, penalties, towing costs, traffic violations, third-party claims, or business interruption arising out of or relating to:

use of or inability to use the Platform;
listings, bookings, rentals, vehicle condition, maintenance, operation, accidents, breakdowns, theft, injury, loss, or disputes between users;
actions or omissions of Hosts, Renters, passengers, or third parties;
payment-provider issues, fraud, chargebacks, or verification-provider decisions;
interruption, suspension, delay, or termination of the Platform.

To the fullest extent permitted by law, VRUM’s aggregate liability arising out of or relating to these Terms, the Platform, or any booking, rental, transaction, dispute, accident, or claim shall not exceed the service fee actually paid to and retained by VRUM in connection with the specific booking or transaction giving rise to the claim.

For clarity, this liability cap applies only to amounts retained by VRUM as its platform or service fee and does not include rental amounts, security deposits, taxes, payment processing fees, Host earnings, reimbursements, fines, penalties, towing costs, damage claims, insurance deductibles, or other amounts paid to or owed by Hosts, Renters, payment processors, insurers, government authorities, or third parties.

This limitation applies to the fullest extent permitted by law and does not exclude or limit any liability that cannot be excluded or limited under applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless VRUM, its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to:

your use of the Platform;
your listings, bookings, rentals, driving, hosting, or vehicle-related conduct;
your User Content;
your breach of these Terms or any supplemental terms;
your violation of law or third-party rights;
injury, death, loss, damage, dispute, or governmental action connected to your conduct, vehicle, or transaction.

This indemnity applies except to the extent a claim results directly from VRUM’s own non-excludable legal fault.

18. Disputes Between Users

Disputes between Hosts and Renters, including disputes regarding vehicle condition, cleanliness, damage, lateness, no-shows, payment adjustments, tolls, fines, fuel, accidents, personal items, or conduct, are primarily between the users involved.

VRUM may, but is not obligated to:

review information submitted by the parties;
request documents, photos, messages, or evidence;
facilitate communication;
issue a platform-level operational decision, charge adjustment, refund, or hold;
restrict accounts or listings based on dispute history or safety concerns.

Any action taken by VRUM to assist with a dispute does not make VRUM a party to the underlying rental relationship or assume liability for the dispute.

19. Intellectual Property

VRUM and its related marks, logos, design, software, booking flow, interface elements, text, graphics, and platform content, excluding User Content, are owned by or licensed to VRUM and protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, frame, mirror, scrape, reverse engineer, or exploit any portion of the Platform except as expressly permitted by VRUM or by mandatory law.

20. Governing Law and Jurisdiction

These Terms shall be governed by the laws of El Salvador, excluding conflict-of-law principles, except to the extent mandatory law requires otherwise.

Any dispute, claim, or controversy between you and VRUM arising out of or relating to these Terms or the Platform shall be submitted to the competent courts of San Salvador, El Salvador, unless applicable law requires another forum.

Nothing in these Terms limits any non-waivable right or remedy available under applicable consumer protection law.

21. Changes to the Platform and Terms

VRUM may modify, suspend, discontinue, or update any feature of the Platform at any time.

We may also modify these Terms from time to time. When we do, we may notify users by updating the “Last Updated” date and, where appropriate, through email, account notice, banner notice, or other reasonable method.

Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by law.

22. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

VRUM’s failure to enforce any provision is not a waiver of that provision or any other right.

You may not assign or transfer these Terms or your rights or obligations under them without VRUM’s prior written consent. VRUM may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.

These Terms, together with the Privacy Policy and any supplemental platform terms incorporated by reference, constitute the entire agreement between you and VRUM regarding the Platform.
